Delivery, change-of-mind returns, faulty products and warranty claims

1. About this policy
This policy applies to goods purchased from Comrack Pty Ltd ABN 68 606 050 597 trading as Data2Power (Data2Power, we, us or our) through www.data2power.com.au or under a quotation that incorporates this policy. It forms part of the Data2Power Website Terms of Use and Terms and Conditions of Sale.
Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
2. Delivery areas, methods and charges
Available delivery areas and methods are displayed at checkout or stated in the quotation. Delivery charges are calculated or quoted before the customer is bound. Some bulky, heavy, dangerous or remote-area deliveries may require a separate freight quotation.
Customers must provide a complete and accurate delivery address, contact details and any relevant site-access instructions. We do not deliver to a location where the selected carrier cannot safely or lawfully deliver.
3. Processing and delivery estimates
Processing and delivery times shown on the Website or in communications are estimates unless we expressly agree to a fixed date. Standard stocked products are generally prepared after payment clears. Backordered, configured, custom-made and special-order products may have longer lead times, which we will communicate where known.
We will take reasonable steps to meet an agreed timeframe and notify the customer of a material delay. If we cannot supply within the agreed time, or otherwise within a reasonable time, the customer may have rights to cancel the affected goods and receive a refund under the Australian Consumer Law or the contract.
4. Tracking, authority to leave and delivery
Tracking is provided where supported by the carrier. If a customer selects or authorises authority to leave, the carrier may leave the parcel in accordance with that authority where lawful and reasonably safe. The customer should consider the security of the nominated location.
For a consumer sale, risk passes when the goods are delivered to the customer or a person nominated by the customer, except where the customer independently arranges a carrier not offered by Data2Power. For a non-consumer business sale, risk passes as set out in the applicable Terms and Conditions of Sale.
5. Incorrect address, failed delivery and collection
If delivery fails because the address is incorrect, the recipient is unavailable, access is restricted or the parcel is not collected, the carrier may return it to us. We may charge the reasonable additional cost of redelivery or storage after notifying the customer. We will not charge those costs where the failed delivery was caused by Data2Power or its carrier.
6. Missing, damaged or incorrect deliveries
Customers should inspect deliveries promptly and contact us as soon as practicable if:
- the parcel or product is visibly damaged;
- an item is missing;
- the wrong product or quantity was delivered; or
- tracking shows delivery but the parcel cannot be located.
Please retain packaging and provide the order number, photographs and relevant details so we can investigate with the carrier. A failure to notify us within a particular period does not remove rights that cannot lawfully be excluded, although prompt notice may assist the investigation.
Where Data2Power is responsible, we will provide the remedy required by law and cover reasonable associated freight costs.
7. Change-of-mind returns
Data2Power offers a voluntary 14-day change-of-mind return for eligible standard stocked products. The customer must contact us within 14 days after delivery and obtain return instructions before sending the product.
To be eligible, the product must be unused, uninstalled, undamaged, complete, in resaleable condition and returned with its original packaging, accessories, manuals and proof of purchase.
Unless Data2Power agrees otherwise, change-of-mind returns are not available for:
- custom-made, cut-to-length, configured, programmed, labelled or modified products;
- special-order or procured-to-order products obtained specifically for the customer;
- clearance items expressly marked as non-returnable for change of mind;
- sealed products where the seal has been broken and the product cannot reasonably be resold for safety, licensing or hygiene reasons; or
- products damaged after delivery through misuse, installation, handling or inadequate return packaging.
The customer pays change-of-mind return freight and bears the risk of loss or damage in return transit. Original delivery charges are not refunded unless we agree otherwise or the law requires it.
Where a restocking fee is reasonably necessary because an accepted return requires inspection, repackaging or restoration to resaleable condition, we will disclose the proposed fee and its basis before authorising the return. No restocking fee applies to a remedy for faulty, damaged, unsafe, misdescribed or otherwise non-compliant goods.
After an eligible return is received and inspected, we will refund the eligible amount using the original payment method where practicable. This voluntary change-of-mind policy is additional to statutory rights.
8. Consumer guarantees and faulty products
Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law. They must, among other things, be of acceptable quality, fit for any purpose made known to us, match their description and correspond with any sample or demonstration model.
If a product has a major failure, a consumer is entitled to reject it and choose a refund or replacement, and may also be entitled to compensation for reasonably foreseeable loss or damage. If a failure is not major, Data2Power may choose to repair the product within a reasonable time. If we do not do so, the consumer may have further rights under the Australian Consumer Law.
A business purchaser may also be a consumer under the Australian Consumer Law in some circumstances. Sale, clearance, opened or custom status does not remove statutory rights concerning a fault or other failure to comply with a consumer guarantee.
9. Data2Power 12-month warranty against defects
In addition to rights under the Australian Consumer Law, Data2Power warrants that goods manufactured or supplied under the Data2Power brand will be free from defects in materials and workmanship for 12 months from the date of purchase, unless a longer written warranty is stated for the product.
To claim, contact us using the details in section 12, provide proof of purchase, identify the product and describe the problem. We may request photographs, test information or return of the product. Where the claim is valid, we will arrange or reimburse reasonable return freight and, at our option to the extent permitted by law, repair, replace or refund the product.
This additional warranty does not cover damage caused by misuse, accident, unauthorised modification or repair, incorrect installation, operation outside stated ratings or environmental limits, failure to follow instructions, normal wear and tear, external events such as surges or liquid ingress, or illegible or removed identification. An exclusion applies only to the extent the excluded event caused or contributed to the problem.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The benefits of this warranty are in addition to other rights and remedies available under law.
10. How to request a return or make a claim
Before returning a product, contact Data2Power and provide:
- the order or invoice number and proof of purchase;
- the product name, model and serial number where applicable;
- the reason for the return or details of the fault;
- photographs or test information reasonably requested; and
- the preferred contact details for the claim.
We will provide return instructions and, where applicable, a return reference. Products should be packaged to prevent transit damage and must not include unrelated equipment or confidential data.
If a product is large, heavy, installed or unsafe to return, contact us before disconnecting or shipping it. Where the Australian Consumer Law requires us to collect goods or bear return costs, we will make appropriate arrangements.
11. Assessment and refunds
We may reasonably assess a returned product to confirm the reported problem and appropriate remedy. Assessment will not be used to delay or deny a statutory remedy. If no fault is found or the problem arose from an excluded cause, we will explain the result and seek approval before performing chargeable work or arranging return freight.
Approved refunds will be made promptly using the original payment method where practicable. Bank and payment-provider processing times may affect when funds appear. A refund required under the Australian Consumer Law will be for the amount legally required and will not be reduced by a restocking or processing fee.
